Why imported-worker applications get rejected 2026: 7 common failure points & prevention

When an imported-worker quota application is rejected, the employer's first reaction is usually "the policy has tightened". In practice, most rejections have nothing to do with policy — the application's own details went wrong. Here are the 7 failure points we see most often, with the cause and the prevention for each.
1. Not enough local employees for the ratio
ESLS has a local-employee ratio: 2:1 for most industries (2 full-time local employees per imported worker); since 16 June 2026, the food & beverage sector is tightened to 3:1. If the ratio falls short, the application simply does not pass.
**Prevention:** count full-time local employees on your MPF contribution records before filing — do not include part-timers.
2. Wages below the published median
Imported-worker wages cannot sit below the Labour Department's published median for the role (e.g. waiter median HK$15,820 — the LD figure at application time prevails). Enter a lower figure and the application is flagged almost on sight.
**Prevention:** check the positions & salary guide and use the latest published median at filing time.
3. Non-compliant accommodation
Accommodation deductions are capped (20% generally, 10% in specified cases) and per-capita net floor area must be ≥ 3.4 m². Dormitory address, floor area and headcount that do not line up are a common rejection point.
**Prevention:** measure the per-capita area and write the deduction arrangement clearly before filing.
4. Old form versions
Since 12 October 2026, the Labour Department only accepts ESLS-1A / ESLS-1B (Rev. 9/2026); old versions are rejected outright. See the new forms guide.
**Prevention:** verify the form revision date reads 9/2026 before submission.
5. Incomplete local recruitment records
Local recruitment must be completed before applying (4 weeks generally; 6 weeks for F&B since 16 June 2026), with ads, interviews and applicant records kept. Missing records or inconsistent dates invite challenges.
**Prevention:** archive ad screenshots, applicant lists and interview notes.
6. Inconsistent company details
If the company name or address on the form differs from the Business Registration — even by one character — expect the file to be returned with queries.
**Prevention:** check every field against the Business Registration Certificate before filing.
7. Non-standard position wording
Self-invented job titles or overly generic wording that does not match the Labour Department's common-positions table will be sent back for clarification.
**Prevention:** use the common-positions table wording — do not invent titles.
What to do after a rejection
Rejection is not the end — read the rejection letter's stated reason, fix it and re-apply. But each round trip costs weeks, so the real time-saver is a thorough pre-submission check. If you want help with that, see how to choose an agency — or just ask us.
FAQ
Q: Can a rejected application be appealed? A: You can re-apply with corrected information. The key is understanding the specific reasons in the rejection letter and fixing each one.
Q: What is the most common rejection reason? A: In practice: insufficient local-employee ratio, wages below the median, and incomplete local recruitment records. Since mid-October 2026, old-form rejection has joined the list.
Q: How long does re-applying take? A: After completing the documents, the application rejoins the queue — typically several weeks to two months depending on complexity.
Q: Can an agency guarantee approval? A: Nobody can guarantee a government decision — but a licensed agency can check every item before submission and sharply reduce the chance of a return.
