Imported-worker contracts do not renew automatically. Employers must re-apply to the Labour Department and meet local recruitment, pay and staffing-ratio requirements. Many employers assume renewal is just an extension of dates; in reality the application goes through approval again.

1. Renewal is not automatic

After a contract ends, re-employing the same worker still requires a fresh application to the Labour Department — not a simple extension.

2. The government re-approves

The Labour Department re-assesses whether the shortage persists, your local recruitment record, and whether the terms of employment still qualify.

3. Start early

Documents, local recruitment, approval and visa extension all take time; begin about six months ahead.

Even when re-hiring the same worker, the Labour Department may require fresh local recruitment to prove the vacancy cannot be filled locally.

Is renewal guaranteed to succeed?

No. Every renewal is re-approved; the Labour Department decides on the company’s actual circumstances.

Does renewal require fresh local recruitment?

Sometimes — it depends on Labour Department requirements; we confirm before applying.

How early should renewal start?

Generally nine months before contract expiry, leaving time for documents and approval.

What if the worker resigns mid-contract?

End the contract per the standard employment contract and the Employment Ordinance — proper notice or payment in lieu, settling all wages and leave pay — then file the ESLS-13 termination notice with the Labour Department and Immigration Department within seven days, followed by the replacement request letter. You may then recruit a replacement under the same quota, but the replacement’s contract can only use the remaining months of the original quota — e.g. a 24-month quota where the first worker resigned after 2 months leaves at most 22 months for the replacement, never exceeding the original remaining term.
