Hiring Mainland workers for Hong Kong 2026: how designated labour-export enterprises work

Many employers assume hiring a Mainland worker means recruiting in the Mainland themselves, agreeing a wage, then filing paperwork back in Hong Kong. It does not. Under the Enhanced Supplementary Labour Scheme (ESLS), the visa stage for Mainland employees must be handled by designated Mainland labour-export enterprises. This is a hard requirement — there is no way around it.
This guide explains how the system works, where employers get stuck, and how to plan properly.
Why must a designated enterprise be involved?
The Mainland regulates labour export specifically: workers departing for Hong Kong must be recruited, vetted, contracted and dispatched by Mainland enterprises holding foreign labour-cooperation qualifications. Even with an approved Labour Department quota, a Hong Kong employer cannot skip this step and hire directly.
In other words, the Hong Kong quota application and the Mainland labour-export procedures are two parallel tracks — both must complete before the worker can start.
How the process runs
- Step 1: the Hong Kong employer applies for an ESLS quota (see quota application process) - Step 2: once the quota is approved, the employer confirms the hiring requirements (roles, headcount, wages at or above the published median) - Step 3: the designated Mainland enterprise recruits, verifies identity and credentials, and arranges medical checks - Step 4: the enterprise processes the worker's Hong Kong entry documents - Step 5: the worker arrives; the employer arranges accommodation and onboarding
End to end, expect 4–6 months (see application process & fees). An approved quota stays valid for 1 year, so there is planning flexibility — but do not wait until the lease and renovation are done before filing.
The three most common employer misunderstandings
**Misunderstanding 1: "I know a Mainland agent, I can recruit directly."** No. Only designated labour-export enterprises can process the departure formalities; ordinary Mainland agents do not hold this qualification.
**Misunderstanding 2: "The worker can just cross the border themselves."** No. Entry documents are coordinated by the designated enterprise; a personal tourist endorsement cannot be used for employment.
**Misunderstanding 3: "Once the quota is approved, everything is done."** The quota is only the Hong Kong-side entry ticket. The Mainland formalities, visa and accommodation arrangements are what make the hire actually land.
Where costs sit
The designated enterprise's service fee is a Mainland-side cost, separate from Hong Kong government charges (the one-off Employees Retraining Levy of HK$9,600 and the visa fee of about HK$330). Budget the two sides separately. Hong Kong agency service fees are quoted separately by scope.
FAQ
Q: Can I hire a Mainland worker without going through a designated enterprise? A: No. Under ESLS, the Hong Kong entry-visa formalities for Mainland employees must be handled by a designated Mainland labour-export enterprise; the employer cannot bypass this.
Q: Which companies are designated? A: The Labour Department publishes the list of designated enterprises, and it is updated from time to time. Verify the latest version before applying, or have your Hong Kong agency handle it.
Q: Does going through a designated enterprise add a lot of time? A: Normally not — experienced enterprises have established handover routines with Hong Kong agencies. Delays usually come from incomplete quota-application paperwork on the Hong Kong side.
Q: Do workers from other places (e.g. Nepal, Vietnam) also need a designated enterprise? A: The designated-enterprise system applies to Mainland workers. Arrangements for other countries differ — covered in a separate article.
